1. Introduction

Welcome to CiacobaCabs.com. These Terms of Service (“Terms”) govern your use of our website, mobile application, and transportation services (collectively, the “Service”) operated by CiacobaCabs.com (“we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Definitions

  • “You” refers to the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
  • “Ride” refers to the transportation service provided by our drivers.
  • “Driver” refers to the individual operating the vehicle and providing the transportation service.

3. Use of the Service

3.1 Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this eligibility requirement.

3.2 Account Registration

To use certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.3 Account Security

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Booking and Cancellation

4.1 Booking Process

You may book a Ride through our website, mobile application, or by phone. By booking a Ride, you agree to pay the fare and any additional charges as specified at the time of booking.

4.2 Cancellation Policy

You may cancel a Ride at any time before the Driver arrives at the pickup location. Cancellation fees may apply as follows:

  • No fee if cancelled within 5 minutes of booking
  • €5 fee if cancelled more than 5 minutes after booking but before the Driver is en route
  • €10 fee if cancelled after the Driver is en route

We reserve the right to charge the full fare for no-shows or if the Driver waits more than 10 minutes at the pickup location.

5. Ride Rules and Regulations

5.1 General Conduct

You agree to behave in a respectful and lawful manner during the Ride. We reserve the right to refuse service or terminate a Ride if you engage in disruptive, unsafe, or illegal behavior.

5.2 Child Safety

For the safety of child passengers, we strictly adhere to Maltese law regarding child restraint systems:

  • Children under 3 years old must use an appropriate child car seat.
  • Children between 3 and 12 years old (or up to 150 cm in height) must use an appropriate booster seat.
  • It is the responsibility of the accompanying adult to provide an appropriate child seat or booster seat.
  • If you require a child seat or booster seat, you must inform us at the time of booking. We may be able to provide these for an additional fee, subject to availability.
  • We reserve the right to refuse transportation if the appropriate child restraint system is not available.

5.3 Luggage and Personal Items

You are responsible for your personal belongings during the Ride. We are not liable for any loss, damage, or theft of personal items left in the vehicle.

5.4 No Smoking Policy

Smoking, including e-cigarettes, is strictly prohibited in all our vehicles.

6. Fares and Payment

6.1 Fare Calculation

Fares are calculated based on distance, time, and any applicable surcharges. The estimated fare will be provided at the time of booking but may be subject to change based on the actual route taken or waiting time.

6.2 Payment Methods

We accept payment by credit/debit card through our secure online payment system powered by Stripe, as well as cash payments directly to the Driver. For online payments, you agree to provide accurate and complete payment information.

6.3 Receipts

A receipt for your Ride will be emailed to you if you provide an email address. You can also request a physical receipt from the Driver.

7. Promotions and Referrals

We may offer promotional codes or referral programs from time to time. These are subject to their own terms and conditions, which will be communicated at the time of the offer.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall CiacobaCabs.com, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the Service.

9. Indemnification

You agree to defend, indemnify, and hold harmless CiacobaCabs.com and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Malta, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
